Audley Cricket Club – Contract for Hire of club facilities.

 

Terms and Conditions of Contract:

 

1, Contract:

(a) These terms and conditions together with the booking form represents your (the client) contract (the contract) with Audley Cricket Club (Audley CC) in relation to the hire of Audley CC.

(b) The client shall return the signed booking form and associated payment of the required deposit by the date specified on the booking form; minimum requirement of 7 days prior to the booking event.  Failure to return the form and provide sufficient payment of the deposit may prevent the booking from being confirmed by Audley CC.

(c) Audley CC grants the client licence to use the room during the hours set out in the booking form (the duration) for the purpose of the forthcoming event detailed in the booking form (The Event)

(d) The hire of the cricket club is subject to Audley CC members being allowed access to the club during the event.  Audley CC cannot be closed down for the restrictions of private parties, as Audley CC is a members’ club and, as such, must allow access for those members at all times.

(e) These terms contain the entire agreement between the parties and unless otherwise agreed in writing by an authorised officer of Audley CC, these terms prevail over any terms of business.

 

2 Amendments;

(a) Any amendments required by the client or Audley CC must be confirmed in writing no less than 7 days prior to the event.

(b) Audley CC must approve the numbers of guests attending the event and can, in its absolute discretion, limit the numbers of guests permitted to attend the event.

 

3 Facilities & Equipment

(a)    Subject to availability, Audley CC can provide facilities and equipment set out in the booking form.

(b)   At the time of confirmation the client shall inform Audley CC if they wish to bring in and use any equipment at the event.  Agreement for access to the facilities and any other requirement shall be confirmed in no less than 7 days prior to the event.  The client will be responsible for the security and insurance of such equipment and compliance with current Health & Safety standards.

 

4 Charges

(a) All charges for the provision of the room hire will be inclusive of VAT

(b) The client will pay the final sum on the date of the event.  Cash and Cheque payments only.

 

5 Payment

(a) The client will pay a fee of £125 (£50 will be refunded 24 hours after the event if no damages are incurred, to be collected from ACC).  The fee is to be paid no less than 7 days prior to the event.  Failure to pay the deposit in accordance with the above may prevent the booking from being confirmed by Audley CC.

 

6 Cancellation:

Where the client cancels the event, Audley CC reserves the right to apply the following cancellation charges:

(a) 6 days or less 100% of the total room hire fee

(b) 7-20 days prior to the event £55.

(c) 21-30 days prior to the event £35.

(d) Over 30 days no charge.

 

7 Liability

Audley CC does not accept liability for any failure to provide contracted services for reasons which are due to circumstances beyond its control, including (but not limited to) failure of gas, water, electricity, water supply.

(a)   Audley CC will not be liable for damage or loss of any property belonging to or in the care or custody of the client, his/her guests, servants, agents or other attendees in the room.

(b)   Audley CC will not be liable for Death by injury to the client, his/her guests, servants, agents or other attendees to the room, except where and to the extent that such an injury is caused by direct negligence of Audley cricket club.

(c)   Audley CC will not be liable for any losses, claims, damages, actions, proceedings, costs or expenses or any other liability incurred by the client, its guests, servants, agents in the exercise, purported exercise or breach of any rights granted by this contract.

 

8 Liability of the client

The client shall be liable for and shall indemnify Audley CC and keep Audley CC indemnified against all losses, claims, demands, actions, proceedings, damages, costs or other liability (including consequential loss or damages) arising in any way from this contract.

 

9 Clients obligations

The client agrees and undertakes to:

(a)   Ensure that the persons attending the event observe these terms and conditions.  Do not commit any nuisance, disturbances, damage, annoyance, inconvenience or interference to the premises or any adjoining neighbouring premises and comply with all reasonable requests of Audley CC.

(b)   Comply with all security, fire and other regulations and statuary requirements relating to the premises and not commit any illegal acts.

(c)   Not carry out any electrical or other works, use their own equipment or fix anything to the floors, ceilings, walls or any other part of the premises without prior consent from an authorised officer of Audley CC.

(d)   Not bring any inflammable, toxic or dangerous items onto the premises and remove any items promptly when requested to do so.

(e)   Not bring or consume any food, beverages or alcohol on the premises other than those supplied by Audley CC or where Audley CC has given written consent that the client consumes their own.

(f)     Not to carry on any betting, gaming or auctioning activity on the premises.

(g)   Not to cause any damages to the premises and forth with to make good any damage caused at its own cost and to the reasonable satisfaction of Audley CC.

(h)  Only use the premises for the purpose of the event.

(i)     To leave the premises in a clean and tidy condition

 

General

No variation to this contract shall be effective unless in writing and signed on behalf of Audley CC and its client.
